Acceptance Of Terms

By contacting Acti-Kare Responsive In-Home Care (“Acti-Kare,” “we,” “us,” or “our”) to request, schedule, or receive any home care services, or by using our website at www.actikare.com, you (“Client,” “you,” or “your”) agree to be bound by these Terms and Conditions. If you are acting on behalf of another individual (such as a care recipient), you represent that you have full authority to accept these Terms on their behalf.

Please read these Terms carefully before using our services. If you do not agree to these Terms, you must not use our services or website.

Description Of Services

Acti-Kare provides non-medical, in-home care and support services across the United States, including but not limited to:

Senior Care Services

  • Personal care assistance (bathing, grooming, hygiene)
  • Companion care and emotional support
  • Alzheimer’s and dementia care
  • Memory care support
  • Hospice care assistance
  • Respite care for family caregivers
  • The Acti-Vate Program (activity-based senior engagement)

Family Care Services

  • In-home child care
  • In-home infant care
  • Mommy home care (postpartum support)
  • In-home pet care

Recovery Care Services

  • After-surgery home care
  • Accident and injury recovery care

Acti-Kare caregivers provide non-medical assistance only. Our services do not constitute skilled nursing care, medical treatment, or any form of clinical healthcare. For medical concerns, always consult a licensed healthcare provider.

Service Agreement And Care Plan

Prior to the commencement of services, an Acti-Kare Area Director will meet with you in your home to conduct a care assessment and develop a personalized Care Plan. The Care Plan will outline the scope, schedule, and nature of services to be provided. Services will be rendered in accordance with the agreed-upon Care Plan unless modified in writing by both parties.

Any requested changes to the Care Plan must be communicated to Acti-Kare in advance. Acti-Kare reserves the right to modify, suspend, or terminate services if the requested care falls outside the scope of non-medical in-home care or poses a risk to the caregiver or client.

Caregiver Qualifications And Conduct

All Acti-Kare caregivers are:

  • Screened through background checks prior to placement
  • Trained in accordance with Acti-Kare’s care standards
  • Bonded and insured through Acti-Kare
  • Required to adhere to Acti-Kare’s code of professional conduct

Acti-Kare caregivers are employees or contracted personnel of Acti-Kare franchise operators and are not your personal employees. You agree not to solicit, hire, or engage any current or former Acti-Kare caregiver directly for private care services during the term of your service agreement and for a period of twelve (12) months following the termination of services.

Client Responsibilities

As a Client, you agree to:

  • Provide a safe and respectful working environment for Acti-Kare caregivers
  • Disclose all relevant health conditions, allergies, medications, and care needs of the care recipient
  • Notify Acti-Kare promptly of any changes in the care recipient’s health or circumstances
  • Ensure that pets are properly secured during caregiver visits, unless pet care is included in the Care Plan
  • Refrain from requesting caregivers to perform tasks outside the agreed Care Plan, including medical procedures, heavy construction, or hazardous activities
  • Treat all Acti-Kare staff with dignity and respect; abusive or threatening behavior toward caregivers is grounds for immediate termination of services

Fees, Billing, And Payment

Service fees are determined by the local Acti-Kare franchise operator based on the type, duration, and frequency of care required. Specific rates will be disclosed during the care assessment prior to service commencement.

Payment Terms

  • Invoices are typically issued on a weekly or bi-weekly basis, as agreed
  • Payment is due upon receipt unless otherwise specified in your service agreement
  • Accepted payment methods include check, electronic funds transfer, and major credit cards (varies by location)

Long-Term Care Insurance

Acti-Kare works with many long-term care insurance providers. It is the Client’s responsibility to understand their insurance coverage and submit claims as required. Acti-Kare may assist with documentation where possible but does not guarantee insurance reimbursement.

Veterans Programs

Acti-Kare participates in certain veterans’ assistance programs. Eligibility and funding are determined by the applicable program administrators. Clients are responsible for verifying their eligibility and maintaining program compliance.

Cancellations And Scheduling

We understand that schedules may change. The following policies apply:

  • Cancellations must be made at least 24 hours in advance to avoid a cancellation fee
  • Same-day cancellations may be subject to a charge equivalent to a minimum service visit
  • Repeated late cancellations may result in review or termination of the service agreement
  • Acti-Kare will make reasonable efforts to provide a replacement caregiver in the event of caregiver absence

Privacy And Confidentiality

Acti-Kare is committed to protecting the privacy of clients and care recipients. All personal health information, financial information, and household details shared with Acti-Kare will be held in strict confidence and used solely for the purpose of providing services.

Caregivers are required to maintain the confidentiality of all client information. They are prohibited from sharing, photographing, or recording any private client information without express written consent.

Limitation Of Liability

Acti-Kare provides non-medical in-home care services and is not a licensed medical provider. To the fullest extent permitted by applicable law:

  • Acti-Kare is not liable for any health outcomes, medical decisions, or medical emergencies that arise during or after the provision of services
  • Acti-Kare’s total liability for any claim arising out of or related to services shall not exceed the total fees paid by the Client in the thirty (30) days preceding the claim
  • Acti-Kare is not responsible for loss or damage to personal property unless caused by the gross negligence or willful misconduct of a caregiver
  • Acti-Kare is not liable for delays or failures in service caused by circumstances beyond our reasonable control, including natural disasters, government actions, or public health emergencies

Indemnification

You agree to indemnify and hold harmless Acti-Kare, its franchise operators, officers, employees, and caregivers from and against any claims, damages, losses, or expenses (including reasonable legal fees) arising from: (a) your breach of these Terms; (b) your failure to disclose material information about the care recipient’s condition; or (c) your negligent or wrongful acts.

Termination Of Services

Either party may terminate the service agreement with at least 48 hours written notice. Acti-Kare reserves the right to terminate services immediately and without notice in cases where:

  • The safety of the caregiver is at risk
  • The Client or care recipient engages in abusive, threatening, or unlawful behavior
  • The requested services fall outside our scope of care
  • Payment obligations are not met

Upon termination, the Client remains responsible for payment of all services rendered up to the date of termination.

Franchise Operations

Acti-Kare services are delivered through a network of independently owned and operated franchise locations throughout the United States. Each franchise operator is an independent business entity and is solely responsible for the employment, conduct, and actions of their caregivers. Acti-Kare Responsive In-Home Care (the franchisor) does not directly employ caregivers or directly provide care services.

When you engage with a local Acti-Kare franchise, your service agreement is with that franchise operator. These Terms and Conditions govern the general standards and expectations across the Acti-Kare network.

Website Terms Of Use

By accessing www.actikare.com, you agree to use the website for lawful purposes only. You may not:

  • Use the website to transmit any harmful, offensive, or unlawful content
  • Attempt to gain unauthorized access to any portion of the website or its systems
  • Reproduce, distribute, or modify any website content without written permission from Acti-Kare
  • Use automated tools to scrape, crawl, or extract data from the website

Acti-Kare makes no warranty that the website will be uninterrupted, error-free, or free of viruses. Use of the website is at your own risk.

Intellectual Property

All content on the Acti-Kare website and in our marketing materials, including logos, text, images, graphics, and the “Acti-Vate Program” name and methodology, are the intellectual property of Acti-Kare Responsive In-Home Care or its licensors. Unauthorized use is strictly prohibited.

Governing Law And Dispute Resolution

These Terms and Conditions shall be governed by the laws of the State of Florida, without regard to its conflict of law principles. Any dispute arising from or related to these Terms or Acti-Kare services shall first be submitted to good-faith mediation. If mediation is unsuccessful, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

You agree that any claims must be brought in your individual capacity and not as part of a class action.

Modifications To These Terms

Acti-Kare reserves the right to update or modify these Terms and Conditions at any time. Updated Terms will be posted on our website at www.actikare.com with a revised effective date. Continued use of our services after such changes constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.

Severability

If any provision of these Terms is found to be unenforceable or invalid under applicable law, such provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible, without affecting the validity and enforceability of the remaining provisions.

Entire Agreement

These Terms and Conditions, together with your signed Care Plan and Service Agreement and Acti-Kare’s Privacy Policy, constitute the entire agreement between you and Acti-Kare with respect to the subject matter herein, and supersede all prior or contemporaneous discussions, agreements, or understandings.
